LIQUID POLYMERS LIMITED - RUBBA-ROOF PROFESSIONAL PRODUCT WARRANTY

LIQUID POLYMERS LIMITED hereby warrant that Rubba‐Roof Professional when used as a roofing membrane by a duly authorised applicator and applied in accordance with the manufacturer’s recommendations is free from defect. In the unlikely event that the material does not remain watertight for a period of 30 years from the date of application Liquid Polymers Limited will replace the product free of charge subject to the conditions below having been met.

    1. Any water penetration must be reported, in writing, immediately upon discovery to Liquid Polymers Ltd., Station House, Station Road, Tisbury, Salsibury, SP3 6JT.
    2. Any and all water proofing membranes, rainwater gutters and outlets must have been regularly and properly maintained in line with the current British Standard Code of Practice.
    3. Liquid Polymers Limited its agents or representatives must be allowed access to inspect the area where the product alleged to be defective has been applied.
    4. Full payment for the product must have been received by Liquid Polymers Limited in accordance with its Conditions of Sale.
  2. The total amount which Liquid Polymers Limited is liable for is the cost of replacing the product used.
  3. In any event and notwithstanding anything contained in this Warranty in no circumstances shall Liquid Polymers Limited be liable, in contract, tort (including negligence albeit a statutory duty) or otherwise howsoever, and whatever the cause thereof, (i) for any increased costs or expenses, or (ii) for any loss of profit, business, contracts, revenues or anticipated savings, or (iii) for any special, indirect or consequential damage of any nature whatsoever.
  4. This Warranty does not cover any defects arising from the application of the product for which the applicator must provide a separate warranty in respect of defective and/or negligent applications.
  5. This Warranty will be rendered invalid should any of the area to which the product has been applied has been affected by any act, or failure to act, by any parties other than Liquid Polymers Limited or where the premises upon which the product has been used has itself been used for purposes which render the area upon which the product has been used unsuitable for the use of the product.
